Provisions for Adding New Technologies to the List of Acceptable Technologies.(1) Any person may, by providing a written request that includes a full explanation of a proposed technology which meets the requirements of this section, petition the department to review the technology. If the department determines that the technology is acceptable for use by state agencies, the department shall draft rules to add the proposed technology to the list of acceptable technologies.(2) The department has 90 days from the date of the request to review the petition and either accept or deny it. If the department does not approve the request within 90 days, the petitioner's request shall be considered denied. If the department denies the petition, it shall notify the petitioner in writing of the reasons for denial. The petitioner may appeal the department's denial of the petition at the next board meeting.
