(a) No advertising is used to influence a recipient's free choice of a pharmacy and no advertising is used that, in the opinion of the Commission, is designed to or has the effect of promoting the volume of prescriptions provided under the Vendor Drug Program.(b) Advertisements should convey only participation in the program.(c) The sign supplied by the Commission may be used at the discretion of the pharmacy. Announcements of the participation in the Vendor Drug Program may be made on radio, on television, in newspapers, or in the media. Bargains, premiums, or other considerations on prescriptions may not be advertised in any manner that would increase the provider's volume of Medicaid prescriptions.
