(a) HHSC or an MCO may propose to recoup funds paid to a program provider or FMSA as described in:(1) §354.4009(d) of this subchapter (relating to EVV Visit Transaction and EVV Claim); and(2) §354.4013(h) of this subchapter (relating to HHSC and MCO Compliance Reviews and Enforcement Actions.(b) HHSC or an MCO may impose a vendor hold against a program provider or FMSA as described in §354.4013(d) and (g)(3) of this subchapter.(c) HHSC or an MCO may propose to terminate the contract of program provider or FMSA as described in:(1) §354.4007(e)(2)(B) of this subchapter (relating to EVV System); and(2) §354.4013(b)(3) of this subchapter.
