(a) Hearings under this subchapter shall be conducted in accordance with the Texas Administrative Procedure Act (APA), Chapter 2001 of the Texas Government Code.(b) Unless otherwise required by subsection (a) of this section, the rules of this subchapter govern the procedures of hearings under this subchapter, except the judge may:(1) apply a procedural hearing rule of the referring agency when the matter at issue is not addressed in this subchapter;(2) apply the Texas Rules of Civil Procedure when the matter at issue:(A) is not addressed in this subchapter; and(B) is not addressed in a procedural hearing rule of the referring agency; or(3) determine that the matter at issue is governed by other law.
