(a) For all services for which DHS provides remuneration, DHS is in effect, the legal owner of the funds used to pay for the goods or services. DHS has the right and responsibility to seek legal redress for any overpayments that may occur as a result of a provider's actions.(b) The most common form of criminal sanction would take place under the Texas Penal Code, §§31.032, 7.23, and 37.10.
