SECTION/RULE §357.645 - Determining the Amount

To determine the amount of a civil monetary penalty, DHS considers the following:(1) the seriousness of the violation;(2) the person's history in submitting claims; and(3) the amount necessary to deter the person from submitting false claims in the future.
