The Texas Health and Human Services Commission follows 20 CFR §416.1210 in determining what resources to exclude, and also excludes: (1) patrimonial assets that are irrevocably turned over to a religious order following a vow of poverty, which are not considered a transfer of assets; (2) reparation payments received under Sections 500 - 506 of the Austrian General Social Insurance Act; (3) payments received under the Netherlands' Act on Benefits for Victims of Persecution 1940 - 1945; and (4) payments made in the class settlement of the Susan Walker v. Bayer Corporation lawsuit.
