(a) Except as provided by subsection (b) of this section, an applicant is eligible for MTFCY if the applicant:(1) is in foster care when he or she leaves conservatorship of this State;(2) is 18 - 20 years of age (coverage continues through the month of his or her 21st birthday); and(3) is not covered by a health benefits plan offering adequate benefits, as HHSC defines adequate benefits.(b) An individual who was receiving MTFCY as of December 31, 2013, is eligible for MTFCY through the month of his or her 21st birthday regardless of the state that served as conservator at the time the individual left conservatorship.
