SECTION/RULE §372.103 - Composition of a TANF Certified Group

(a) The Texas Health and Human Services Commission (HHSC) may include together in a TANF certified group:(1) each dependent child; and(2) each relative of a dependent child:(A) living with the child in a family setting being established or maintained as shown by the relative through continuing responsibility for the child's day-to-day care; and(B) whose relationship to the child, by blood, marriage, or adoption extends up to the degree indicated in §372.108 of this division (relating to Relationship Requirement).(b) HHSC may continue to include a person in a certified group after the person has entered a nursing facility, so long as HHSC determines the person's stay in the nursing facility is temporary.
