(a) HHS and DFPS may use the open enrollment contracting method if the best interests of the state are served by enrolling multiple vendors.(b) An open enrollment under this section must be conducted in a transparent and fair manner that reasonably provides interested and eligible vendors equal opportunity to obtain a contract.
