SECTION/RULE §61.412 - Actual Pecuniary Loss

(a) The OAG shall award compensation under Texas Code of Criminal Procedure Article 56.34, if the OAG determines that the victim or claimant has incurred an actual pecuniary loss as a result of criminally injurious conduct. This includes actual, reasonable and necessary pecuniary losses incurred by the victim or claimant.(b) Payments or reimbursements from sources not included under Texas Code of Criminal Procedure Article 56.32(a)(3) will be considered when calculating a victim or claimant's actual pecuniary loss. Any payments from other sources may reduce the amount of an award to the victim or claimant to the extent that the payments have reduced the amount of actual pecuniary loss.
