SECTION/RULE §93.89 - Judicial Review of Final Action of the Secretary of State

(a) A final action or final decision of the Secretary of State may be judicially reviewed pursuant to §16.057 of the Business & Commerce Code. An applicant or registrant may seek judicial review of the refusal of the Secretary of State to register a trademark or renew the registration of a trademark by seeking a writ of mandamus in a district court of Travis County, pursuant to §16.106 of the Business & Commerce Code.(b) A person seeking cancellation of a trademark registered by the Secretary of State may bring suit in a district court in Travis County to cancel the registration pursuant to §16.106 of the Business & Commerce Code.
