SECTION/RULE §123.44 - Withholding of Penalties

The Commission shall retain the amounts authorized by Texas Government Code, Chapter 2258 upon a finding that prevailing wages have not been paid. The Commission shall use any amounts retained to pay the affected worker in accordance with Texas Government Code, §2258.056.
