SECTION/RULE §159.1 - Scope and Construction of this Chapter

(a) This chapter applies to contested hearings before SOAH concerning administrative suspension, denial, or disqualification of drivers' licenses under the Administrative License Revocation (ALR) Program governed by Texas Transportation Code, Chapters 522, 524, and 724.(b) These regulations shall be construed to ensure the fair and expeditious determination of every action.(c) These rules shall supplement the procedures required by law. To the extent that any provisions of these rules that are necessary to expedite the hearings process conflict with Texas Government Code, Chapter 2001, the provisions of this chapter shall prevail.(d) When procedural issues arising under Texas Transportation Code, Chapters 522, 524, and 724 cannot be resolved by reference to this chapter, the APA, and applicable case law, then the presiding judge will consider and apply SOAH's Rules of Procedure in Chapter 155 of this title, and/or the Texas Rules of Civil Procedure (TRCP) as interpreted and construed by Texas case law, and persuasive authority established in other forums.(e) An ALR hearing under this chapter is a civil administrative proceeding that is separate and independent from any criminal court proceedings relating to the same arrest.
