SECTION/RULE §131.27 - Motions for Rehearing

(a) The commission may delegate to the board the authority to accept and rule upon motions for rehearing. Unless so delegated, the commission will rule upon motions for rehearing and the provisions of this section will apply. Should the commission delegate this authority, the terms of the delegation will override any conflicting provision in this section.(b) A motion for rehearing in a contested case under the Veterinary Licensing Act must be filed with the department and will be handled in accordance with Texas Government Code, Chapter 2001, Subchapter F, and 16 Texas Administrative Code §60.309.(c) The commission may, in its sole discretion, hear oral argument on a motion for rehearing related to a contested case under the Veterinary Licensing Act.
