SECTION/RULE §68.40 - Owner Responsibilities

(a) An owner with a construction project with an estimated construction cost of $50,000 or more is subject to compliance with the Act, TAS, and this chapter.(b) Within 30 days of the change occurring, an owner must notify the department of a change in:(1) contact information; or(2) property ownership.(c) An owner must report a change in the estimated date of completion of construction to the registered accessibility specialist.(d) When corrective modifications are required, an owner must submit a response on a prescribed form within 30 days to the registered accessibility specialist, in accordance with §68.53, and complete the corrective modifications by the 270th day after the date of the inspection report.(e) When there is not a design professional with overall responsibility for a registered project, the owner must submit the construction documents to a registered accessibility specialist prior to filing an application for building permit or commencement of construction.
