SECTION/RULE §76.62 - Responsibilities of the Department--Injurious Water or Constituents

(a) Within forty-five (45) days after receipt of an Injurious Water or Constituents Report, as described in §76.71, the department shall review the well report for corrective actions taken by the driller.(b) If after its review, the department determines that no corrective actions have been taken, the department shall within thirty (30) days of making that determination, notify in writing the person having the well drilled, deepened or altered, to inform the person that the driller is required by law to ensure that the well is plugged, repaired or completed under the standards and procedures in this chapter.
