A permittee seeking to amend any provision of a Texas weather modification permit must:(1) file a permit amendment application with the Department in accordance with the requirements of §79.18 and pay the required amendment fee(2) unless the Department deems the amendments minor in accordance with §79.55, file and publish a notice of intention with the Department in accordance with the requirements of §79.17; however, the headings of the notice of intention should be altered to reflect the fact that the permittee seeks an amendment rather than an original permit;(3) if the amendment sought by the permittee alters only the delineation of either the operational or target areas to the extent that territory is added to either or both areas, publish the notice of intention only in the counties that include any part of the territory being added to the operational or target areas.
