SECTION/RULE §85.724 - Responsibilities of Licensee--Disposition of Abandoned Nuisance Vehicle

(a) A VSF that holds an abandoned nuisance vehicle is not required to send or publish a second notice and is entitled to dispose of the vehicle on the 30th day after the date the notice is mailed or published under §2303.151 or §2303.152 of the Act.(b) The VSF must:(1) notify the Texas Department of Transportation that notices under Chapter 683, Transportation Code, have been provided and shall pay a fee to the Texas Department of Transportation; or(2) notify the appropriate law enforcement agency and pay a fee to that agency.(c) A law enforcement agency described by subsection (b)(2) may sign a document issued by the Texas Department of Transportation.(d) Public sale. A VSF may dispose of a vehicle through a public sale in compliance with §2303.157 of the Act. Disputes over the sale or dispersal of proceeds from the sale of the vehicle may be pursued through a court of appropriate jurisdiction.
