(a) Subject to subsection (b), the commission may suspend or withhold funds from an organization:(1) that it determines has failed to comply with the requirements or performance measures adopted under Section 2028.001, Tex. Occ Code; or(2) for which material questions on the use of funds by the organization are raised following an independent audit or other report to the commission.(b) The commission shall not withhold funds from an organization pursuant to subsection (a) unless:(1) the commission has notified the organization of all outstanding requirements, performance measures, and material questions on the use of funds by the organization and has provided at least 30 days for the organization to address the issue(s); and(2) the issues remain unresolved after the deadline indicated in the letter.
