SECTION/RULE §401.352 - Settlement Procedures

(a) The commission may require a retailer to establish a single separate electronic funds transfer account, where available, for the purpose of receiving monies from ticket sales, making payments to the commission and receiving payments from the commission. Failure to have sufficient funds available to cover an electronic funds transfer to the commission's account shall be cause for suspension, summary suspension and revocation of a retailer's license at each location where such retailer is licensed. Further, if a check or electronic transfer of funds to the commission is dishonored, the commission may take any and all actions authorized by law, including requiring the retailer to pay a service charge and collection and litigation expenses.(b) Retailers may be required to file with the commission, or its designated representative, reports of the retailer's receipts and transactions in the sale of lottery tickets on a form or in a manner as prescribed by the executive director.
