SECTION/RULE §10.238 - Additional Requirements

(a) A grant award is automatically terminated if the grantee is placed on probation by the Texas Board of Nursing or loses its status as an approved professional nursing program. The grantee shall immediately return all unexpended grant funds.(b) Each grantee shall return any award funds remaining unspent at the end of the grant term as set forth in the RFA or Notice of Grant Agreement (NOGA) to the Coordinating Board within ninety (90) calendar days after written demand or an earlier due date if specified by the RFA.(c) Each grantee shall return or repay to the Coordinating Board any award funds that the State determines an eligible institution improperly expended on items not listed in the RFA or otherwise prohibited by law within the time frame and subject to the requirements set forth in the RFA.(d) The Commissioner may take the following actions if a grantee fails to comply with requirements set forth in the RFA:(1) Reduce the grant award;(2) Require the grantee to return unspent grant funds;(3) Amend the grant agreement; or(4) Terminate the grant agreement.(e) The RFA may set forth additional return or reimbursement of fund requirements and termination provisions.(f) The Coordinating Board may retain returned and reimbursed funds for the next RFA.
