(a) Unless otherwise stipulated at the time of approval, if an approved new degree program does not enroll students within two years of approval, that approval is no longer valid.(b) An institution may submit a request to the Assistant Commissioner for approval to lengthen that time limit by up to five years from the approval date. The request must include a description of the good cause or compelling academic reason for extending the program implementation timeline.(c) The Commissioner has discretion to approve or deny the request if the Commissioner determines there is good cause for the extension, and it is in the best interest of the students to be served by the program.(d) Unless otherwise stipulated at the time of approval, if the institution does not implement the approved program revision or modification within two years of approval, that approval is no longer valid.(e) Provisions of this section apply to all approvals and changes under this chapter.
