SECTION/RULE §189.13 - Procedural Rules

(a) The Procedural Rules in Chapter 179 of this title shall apply, except to the extent those rules conflict with the Act, in which case the Act controls.(b) The rules related to Complaints and Investigations in Chapter 177 of this title shall apply, except to the extent those rules conflict with the Act, in which case the Act controls.(c) The rules related to Disciplinary Guidelines and Sanctions in Chapter 180 of this title shall apply, except to the extent those rules conflict with the Act, in which case the Act controls, including, but not limited to:(1) practice inconsistent with public health and welfare;(2) unprofessional or dishonorable conduct;(3) disciplinary actions by state boards;(4) aggravating and mitigating factors; and(5) criminal convictions.(d) The rules related to Compliance in Chapter 181 of this title shall apply, except to the extent those rules conflict with the Act, in which case the Act controls.
