SECTION/RULE §117.11 - General Requirements for a License

(a) A facility shall obtain a license prior to admitting patients.(b) A facility shall prominently and conspicuously display the license in a public area of the licensed premises that is readily visible to patients, employees, and visitors.(c) A facility license shall not be altered.(d) A facility license shall not be transferred or assigned. The facility shall comply with the provisions of §117.12(a) of this title (relating to Application and Issuance of Initial License) in the event of a change in the ownership.(e) The following facilities are not required to be licensed under this chapter:(1) a home and community support services agency licensed under Health and Safety Code, Chapter 142, Subchapter A, with a home dialysis designation;(2) a hospital licensed under Health and Safety Code, Chapter 241, Subchapter B, that provides dialysis only to:(A) individuals receiving inpatient services from the hospital; or(B) individuals temporarily receiving outpatient services from the hospital due to a disaster declared by the governor or a federal disaster declared by the president of the United States occurring in this state or another state during the term of the disaster declaration; or(3) the office of a physician unless the office is used primarily as an end stage renal disease facility.
