SECTION/RULE §229.344 - Exemptions

(a) This subchapter does not apply to a phototherapy device used by or under the supervision of a licensed physician who is trained in the use of a phototherapy device.(b) Personal use of a tanning device by an individual is exempt from the provisions of this subchapter to the extent that such individual owns the tanning device exclusively for personal use and no fee or other compensation is involved in the use of the tanning device.
