SECTION/RULE §295.9 - Reporting Fatalities and Injuries

(a) Employers are required to report to the department the occurrence of any employee accident, including asphyxiation, resulting from a chemical exposure and that is fatal to one or more employees or that results in the hospitalization of five or more employees.(b) Such employee accidents may be reported to the Texas Department of Health, Product Safety Division, Hazard Communication Branch, at toll free telephone number 1-800-452-2791. Reports shall be submitted either orally or in writing no later than 48 hours after the occurrence of the accident. Written reports may be transmitted via facsimile or electronic means.
