SECTION/RULE §263.703 - Denial of a Request for Enrollment into the HCS Program

(a) HHSC denies an individual's request for enrollment into the HCS Program if the individual does not meet the eligibility criteria described in §263.101 of this chapter (relating to Eligibility Criteria for HCS Program Services and CFC Services).(b) If HHSC denies an individual's request for enrollment, HHSC sends written notice to the individual or LAR of the denial of the individual's request for enrollment into the HCS Program and includes in the notice the individual's right to request a fair hearing in accordance with §263.801 of this chapter (Fair Hearing).(c) HHSC sends a copy of the written notice to the individual's service coordinator and the program provider.
