SECTION/RULE §264.233 - Training and Management of Service Providers

(a) An employer or DR must:(1) provide initial, ongoing, and annual training to a service provider on the topics described in HHSC Form 1732, Management and Training of Service Provider, and the applicable Service Provision Requirements Addendum to HHSC Form 1735, Employer and Financial Management Services Agency (FMSA) Agreement; and(2) manage a service provider in accordance with HHSC Form 1732 and the applicable addendum to HHSC Form 1735.(b) An employer or DR must:(1) complete HHSC Form 1732 to document:(A) the training required by subsection (a)(1) of this section;(B) the management of a service provider required by subsection (a)(2) of this section; and(C) an evaluation of the service provider's performance at least annually after the date of hire;(2) sign and date the completed form;(3) ensure the service provider signs and dates the completed form;(4) give the service provider a copy of the signed form; and(5) send a copy of the signed form to the FMSA within 30 calendar days after the date the form is signed by the employer or DR and the service provider.
