SECTION/RULE §277.23 - Attendant Qualifications

An attendant must:(1) meet the requirements described in 26 TAC §558.404(c) (relating to Standards Specific to Agencies Licensed to Provide Personal Assistance Services);(2) not be a legal parent, foster parent, or spouse of a parent of a minor who receives services in the CAS Program;(3) not be the spouse of the individual who receives the service, except for services in the FC Program; and(4) not be designated by an HHSC case worker on HHSC's Authorization for Community Care Services form as "Do not hire."
