SECTION/RULE §306.67 - Additional Standards of Care for Children and Adolescents

(a) In addition to the service requirements in this division, a child or adolescent must receive additional assessments, including a developmental assessment and history of trauma assessment, performed by an LPHA with appropriate training and experience in the assessment and treatment of children in a crisis setting. The assessments must:(1) be administered in person or through telehealth or telemedicine medical services; and(2) include the individual's parents, LAR, or adult caregiver, as applicable and as clinically appropriate according to the child's or adolescent's age, functioning, and current living situation.(b) Services delivered to a child or an adolescent must be:(1) age-appropriate;(2) developmentally appropriate;(3) trauma-informed; and(4) consistent with the child's or adolescent's academic development.(c) Children must be separated from adolescents, based on age and developmental needs, unless there is clinical or developmental justification in the child or adolescent's medical record. Both children and adolescents must be separated from adults, required in §306.87(d) of this subchapter (relating to Protection of an Individual Receiving Crisis Stabilization Unit Services).(d) Education services must be available as required by the Texas Education Agency.(e) When a child or adolescent surpasses the maximum age for their current unit or CSU, the unit or CSU administrator, or administrator's designee, must transition the child or adolescent to a different age-appropriate unit or CSU.
