(a) A JBCR program must recruit, train, and maintain qualified program staff members with documented competency in accordance with Chapter 301, Subchapter G, Division 2 of this title (relating to Organizational Standards), specifically: (1) §301.327(e) of this title (relating to Access to Mental Health Community Services); (2) §301.329 of this title (relating to Medical Records System); and (3) §301.331 of this title (relating to Competency and Credentialing). (b) Before providing services, a JBCR program must train each program staff member and ensure demonstrated competence in: (1) the rights of an individual receiving mental health services as described in Chapter 320, Subchapter A of this title (relating to Rights of Individuals Receiving Mental Health Services); (2) the rights of an individual with an intellectual disability and a legally authorized representative as described in Chapter 334 of this title (relating to Rights of Individuals with an Intellectual Disability); (3) identifying, preventing, and reporting abuse, neglect, and exploitation in accordance with the Texas Commission on Jail Standards or HHSC as set forth in applicable state laws and rules; and (4) using a protocol for preventing and managing aggressive behavior, including preventative de-escalation intervention strategies.
