(a) A JBCR program may only admit an individual to JBCR upon receipt of a court order requiring the individual to participate in JBCR under Texas Code of Criminal Procedure Chapter 46B, Subchapter D.(b) In accordance with Texas Code of Criminal Procedure Article 46B.0735, the initial competency restoration period begins on the later of:(1) the date the individual is:(A) ordered to participate in OCR services; or(B) committed to a mental health facility, residential care facility, or JBCR; or(2) the date competency services begin.(c) When a JBCR program determines an individual is eligible for JBCR, the program must ensure the individual will receive competency restoration services no later than 72 hours after admission to the JBCR program. (d) A JBCR program must, when necessary, seek a court order for psychoactive medications in accordance with Texas Health and Safety Code §574.106 or Texas Code of Criminal Procedure Article 46B.086.
