(a) The provisions of this subchapter apply to all organizations and individuals providing electroconvulsive therapy on an inpatient or outpatient basis, in or on a contractual basis with: (1) all facilities of the Texas Department of Mental Health and Mental Retardation; (2) community mental health and mental retardation centers; (3) psychiatric hospitals licensed by the Texas Department of Health under the Health and Safety Code, Chapter 577; and (4) psychiatric units of hospitals licensed by the Texas Department of Health under the Health and Safety Code, Chapter 241.
