(a) When the subrecipient provides the LEA Notification to the LEA less than 90 days before the child's third birthday, the subrecipient must include in the notification the reason for the delay. (b) The subrecipient must send the LEA for the area in which the child resides a late LEA Notification for any child aged 33-36 months who the IFSP team determines is potentially eligible for ECSE services, unless the parent has informed the subrecipient in writing of their decision to opt out of the LEA Notification.
