SECTION/RULE §52.115 - Subcontracts

If a contractor uses a subcontractor to provide a service to an individual, the contractor must:(1) have a written agreement with the subcontractor that requires the subcontractor and any of its subcontractors to comply with applicable provisions of the contract, this subchapter, and HHSC rules governing services provided under the contract, as if the subcontractor and its subcontractors were the contractor;(2) monitor the subcontractor to ensure that the subcontractor is in compliance with the written agreement referenced in paragraph (1) of this section; and(3) maintain records of its monitoring of the subcontractor.
