SECTION/RULE §52.123 - Personal Attendants

(a) A contractor must comply with requirements regarding payment of a base wage to a personal attendant as described in 1 TAC §355.7051 (relating to Base Wage for a Personal Attendant).(b) A contractor, other than a contractor that has an FMSA contract listed in §49.101(a)(4) of this chapter (relating to Application), must notify a person who becomes employed or contracts with the contractor as a personal attendant that the contractor must pay at least the wage required by 1 TAC §355.7051. The contractor must make this notification within three days after the person accepts employment or enters into a contract with the contractor. For purposes of this subsection, a personal attendant has the meaning set forth in 1 TAC §355.7051(a).
