SECTION/RULE §551.14 - Increase in Capacity

(a) During the license term, a license holder may not increase capacity without approval from the Texas Health and Human Services Commission (HHSC). The license holder must submit to HHSC a complete application, through the online portal, for increase in capacity and the fee required in §551.19 of this subchapter (relating to License Fees).(b) An application for an increase in capacity that was not included in the plan approved under §533A.062 of Texas Health and Safety Code, Plan on Long-Term Care for Persons with an Intellectual Disability, will not be approved by HHSC .(c) Upon approval of an increase in capacity, HHSC will issue a new license.
