SECTION/RULE §553.651 - When may HHSC petition a court for the involuntary appointment of a trustee to operate a facility?

HHSC may petition a court for the involuntary appointment of a trustee to operate a facility when one or more of the following conditions exist:(1) the facility is operating without a license;(2) the facility's license has been suspended or revoked;(3) an imminent threat to the health and safety of the residents exists, and license suspension or revocation procedures are pending against the facility;(4) an emergency exists that presents an immediate threat to the health and safety of the residents; or(5) the facility is closing, whether voluntarily or through an emergency closure order, and arrangements for relocation of the residents to other licensed institutions have not been made before closure.
