(a) This subchapter applies to PI investigations involving an employee as defined in §711.1402 of this subchapter (relating to How are the terms in this subchapter defined?).(b) Notwithstanding subsection (a) of this section, a certified nurse aide who commits reportable conduct while working for an agency is eligible to be reported to the EMR, as provided by §253.001(3), Health and Safety Code.
