SECTION/RULE §747.4812 - Must I provide a personal flotation device (PFD) to a child in care who is unable to swim competently or who is at risk of injury or death when swimming when the child is participating in swim instruction or a competition?

You are not required to provide the child with a PFD or ensure the child is wearing the device if:(1) The child is actively participating in swim instruction or a competition; and(2) You ensure that the child is supervised in accordance with §747.1503 of this chapter (relating to What responsibilities does a caregiver have when supervising a child or children?) during the instruction or competition.
