SECTION/RULE §748.4759 - What mental health services are required for a child receiving trafficking victim services?

(a) A professional service provider must:(1) Provide individual counseling to each child receiving trafficking victim services. The counseling must address any issues noted in the behavioral health assessment and whether intervention and additional treatment is needed for sexual assault;(2) Provide family counseling, as appropriate; and(3) Assess the frequency and duration of the counseling.(b) You must document the assessment in the child's record.(c) If a child refuses counseling, you must document this refusal in the child's record.(d) For purposes of this rule, a professional service provider means:(1) A psychiatrist licensed by the Texas State Board of Medical Examiners;(2) A psychologist licensed by the Texas State Board of Examiners of Psychologists;(3) A master's level social worker or higher licensed by the Texas State Board of Social Work Examiners;(4) A professional counselor licensed by the Texas State Board of Examiners and Professional Counselors;(5) A marriage and family therapist licensed by the Texas State Board of Examiners of Marriage and Family Therapists; or(6) A master's level or higher nurse licensed as an Advanced Practice Registered Nurse by the Texas Board of Nursing and board certified in Psychiatric/Mental Health.
