CHAPTER 904 - CONTINUITY OF SERVICES--STATE FACILITIES
SUBCHAPTER A - GENERAL PROVISIONS
SECTION/RULE §904.1 - Purpose

The purpose of this subchapter is to:(1) establish criteria and procedures for:(A) the admission, placement, or commitment of an individual to a state mental retardation facility in accordance with:(i) the Persons with Mental Retardation Act (PMRA);(ii) the Texas Family Code, Chapter 55; and(iii) the Texas Code of Criminal Procedure, §46.02 and §46.03;(B) the transfer of an individual from:(i) one state MR facility to another;(ii) a state MR facility to a state MH facility; and(iii) a state MH facility to a state MR facility;(C) an individual's move to an alternative living arrangement from a state MR facility; and(D) the discharge of an individual from a state MR facility;(2) describe the responsibilities of the mental retardation authority (MRA) for:(A) the admission, placement, or commitment of an individual to a state MR facility;(B) an individual's move to an alternative living arrangement from a state MR facility; and(C) the review of an individual who moved from a state MR facility prior to September 1, 1997, and has an assignment of community placement in CARE; and(3) describe the responsibilities of the ombudsman in the department's Central Office.
