Except as provided by Labor Code §504.053(b)(2), concerning Election:(1) A person may not operate or perform any act of a workers' compensation health care network in this state:(A) unless the person holds a certificate issued under Insurance Code Chapter 1305, concerning Workers' Compensation Health Care Networks, and this chapter; or(B) except in accordance with the specific authorization of Insurance Code Chapter 1305 or this chapter.(2) A person, including an insurance carrier, who provides or arranges to provide workers' compensation health care network services to injured employees within a service area, must be certified as a workers' compensation health care network under Insurance Code Chapter 1305 and this chapter.(3) An entity performing any act of a workers' compensation health care network may not use in a network's name or in any informational literature distributed about a network any combination or variation of the words "workers' compensation," "certified," "managed care," or "network" to describe a network that is not certified in accordance with this chapter.
