SECTION/RULE §11.2610 - Penalties for Noncompliance

(a) Failure of any party to any agreement under this subchapter to comply with any requirement of this subchapter may result in an order from the commissioner that the HMO must terminate the delegation agreement and resume or redelegate any or all delegated functions as well as the imposition of penalties provided under the Insurance Code and related rules.(b) Any action by an HMO relating to a delegation agreement that does not comply with this subchapter or takes place under a provision of a delegation agreement not in compliance with this subchapter constitutes a violation under this subchapter.
