(a) Complaints against an IRO must be processed under the department's established procedures for investigation and resolution of complaints.(b) As part of its oversight of IROs, the department will conduct compliance audits to ensure that IROs are complying with Insurance Code Chapters 1305 and 4202 and the rules and standards in this chapter.(c) The department may use the authority of Insurance Code §38.001 to make inquiries of any IRO.(d) This chapter does not limit the ability of the commissioner of workers' compensation or TDI-DWC to make inquiries, conduct audits, or receive and investigate complaints against IROs or personnel employed by or under contract with IROs to perform independent review to determine compliance with or violations of Labor Code
