The following two kinds of groups are subject to this subchapter:(1) a group doing business in Texas as a risk retention group or purchasing group, which actually has the status of a risk retention group or purchasing group; and(2) a group doing business in Texas as a risk retention group or purchasing group, but not actually having the status of a risk retention group or purchasing group because the group has not completed the registration process or does not conform to other statutory criteria.
