Each surplus lines agent must maintain a contract file containing a complete and true record for each individual surplus lines contract including the items described under Insurance Code §981.215(a) and the following, as applicable:(1) a copy of the daily report or other evidence of insurance;(2) amount of insurance and perils insured against;(3) brief general description of the property insured and its location, including ZIP code;(4) gross premium;(5) name and mailing address of the insured;(6) name and home office address of the insurer, underwriting syndicate or other risk-bearing entity;(7) record of losses or claims filed and payments made;(8) a true and correct copy of the insurance policy, contract, and other detailed evidences of coverage, as issued to the insured;(9) all correspondence relating to the specific insurance coverage of that contract file;(10) support for exempt commercial purchaser status complying with Insurance Code §981.215(a)(12)(A) and §15.111 of this title; and(11) support for the industrial insured status complying with Insurance Code §981.215(a)(12)(B) and §15.112 of this title.
