A health carrier must:(1) file the consumer choice health benefit plan separate from any state-mandated health benefit plan with the department in accordance with:(A) Insurance Code Chapter 1271 and Chapter 11 of this title (relating to Health Maintenance Organizations) including the filing fee requirements; and(B) Insurance Code Chapter 1701 and Chapter 3, Subchapter A of this title (relating to Requirements for Filing of Policy Forms, Riders, Amendments, Endorsements for Life, Accident, and Health Insurance and Annuities) including the filing fee requirements;(2) before use, file for approval with the department its disclosures required by §21.3530 of this title (relating to Health Carrier Disclosure) and certification of compliance with §21.3542 of this title (relating to Offer of State-Mandated Plan); and(3) file, for informational purposes, the rates to be used with a consumer choice health benefit plan.
