(a) Health carriers offering a consumer choice health benefit plan must file annually with the department a data certification, not later than June 1 of each year, on Form CCP 2, Consumer Choice Health Benefit Plans Data Certification. The data certification includes the following, each set out by plan type:(1) the total number of consumer choice health benefit plans newly issued and renewed covering Texas lives;(2) the total number of Texas lives (including members/employees, spouses, and dependents) covered under newly issued and renewed consumer choice health benefit plans;(3) the gross premiums received for newly issued and renewed consumer choice health benefit plans covering Texas lives; and(4) the average premium rate for consumer choice plans and state-mandated plans.(b) For the purpose of subsection (a) of this section:(1) for plans that are required to develop rates using the federal Unified Rate Review Template, the average premium rate is the average plan-adjusted index rate for each set of plans as submitted for the previous calendar year;(2) for plans that are not required to develop rates using the federal Unified Rate Review Template, the average premium rate is the earned premium divided by the member months for each set of plans, given per member per month, where member months is the number of people enrolled in a plan times the months of enrollment.(c) Form CCP 2 is available on the department's website at www.tdi.texas.gov.
